WELLSY reserves the right to modify the GTC at any time. Modifications will be visible on the website <a href=\"https:\/\/wellsy.io\/en\/\" target=\"_new\" rel=\"noopener\">https:\/\/wellsy.io<\/a> and will apply immediately.<\/p>\n<h3><strong>1. Purpose of the contract<\/strong><\/h3>\n<p>WELLSY offers maintenance services for WordPress sites, including, but not limited to:<\/p>\n<ul>\n<li>Provision of a server<\/li>\n<li>WordPress, plugin and theme updates<\/li>\n<li>Daily backups (storage of 3 backups)<\/li>\n<li>Optimizing server performance<\/li>\n<li>Hourly anti-malware scans<\/li>\n<li>Free, unlimited site restores from available backups<\/li>\n<li>Advanced security and attack management<\/li>\n<li>Unlimited DNS management via CloudFlare<\/li>\n<li>SMTP service configuration for e-mail deliverability via Brevo<\/li>\n<\/ul>\n<h3><strong>2. Services on offer<\/strong><\/h3>\n<p>Services are offered in the form of annual or monthly packages, automatically renewable:<\/p>\n<ul>\n<li><strong>Simple WordPress website package<\/strong><\/li>\n<li><strong>WordPress Marketplace Package<\/strong><\/li>\n<\/ul>\n<p>The choice of package depends on the type of customer site.<\/p>\n<h3><strong>3. Duration and termination<\/strong><\/h3>\n<h4>3.1 <strong>Minimum commitment period<\/strong><\/h4>\n<p>The contract is concluded for a minimum of 12 months from the date of subscription.<\/p>\n<h4>3.2 <strong>Renewal<\/strong><\/h4>\n<p>At the end of the initial period, the contract is automatically renewed for an identical term, unless terminated by either party.<\/p>\n<h4>3.3 <strong>Cancellation<\/strong><\/h4>\n<p>The customer may terminate the contract by giving 30 days' notice prior to the renewal date. The cancellation request must be sent by e-mail to <a rel=\"noopener\">hello@wellsy.io<\/a>. In the event of early termination, the customer is obliged to pay all sums due up to the end of the commitment period.<\/p>\n<h3><strong>4. Terms of payment<\/strong><\/h3>\n<h4>4.1 <strong>Accepted payment methods<\/strong><\/h4>\n<p>Payments are made online via Stripe.<\/p>\n<h4>4.2 <strong>Payment frequency<\/strong><\/h4>\n<p>The customer can choose between monthly or annual payment, both types being recurring.<\/p>\n<h4>4.3 <strong>Late payment<\/strong><\/h4>\n<p>In the event of late payment of more than 30 days, a fixed charge of \u20ac40 excluding VAT (net of VAT) will be applied, as well as late payment interest of 20% of the amount due.<\/p>\n<h3><strong>5. WELLSY's obligations<\/strong><\/h3>\n<h4>5.1 <strong>Maintenance and support<\/strong><\/h4>\n<p>WELLSY undertakes to :<\/p>\n<ul>\n<li>Make the necessary updates to WordPress, plugins and the theme.<\/li>\n<li>Perform weekly backups and store the last two backups on a server in the Netherlands.<\/li>\n<li>Optimize server performance and run hourly anti-malware scans.<\/li>\n<li>Restore the site from available backups if necessary.<\/li>\n<\/ul>\n<h4>5.2 <strong>Service availability<\/strong><\/h4>\n<p>WELLSY will do everything possible to ensure the availability of the service and to restore the operation of the site and\/or the server in the event of an interruption attributable to WELLSY.<\/p>\n<h3><strong>6. Customer's obligations<\/strong><\/h3>\n<h4>6.1 <strong>Legal use<\/strong><\/h4>\n<p>The Customer undertakes to use the services of WELLSY only for legal purposes and in accordance with the laws in force in France.<\/p>\n<h4>6.2 <strong>Information and access<\/strong><\/h4>\n<p>The Customer must provide WELLSY with all the information and access necessary for the maintenance of the site, including the access codes and identifiers required.<\/p>\n<h4>6.3 <strong>Payment<\/strong><\/h4>\n<p>The Customer undertakes to honour payments on each due date in accordance with the agreed terms.<\/p>\n<h3><strong>7. Limitations and exclusions of liability<\/strong><\/h3>\n<h4>7.1 <strong>Site content<\/strong><\/h4>\n<p>WELLSY does not agree to host or maintain illegal or pornographic sites. In case of violation, WELLSY reserves the right to terminate the contract without notice.<\/p>\n<h4>7.2 <strong>Technical limitations<\/strong><\/h4>\n<p>The Customer's disk space is limited to 30 GB for classic site maintenance and 60 GB for marketplace site maintenance. If this limit is exceeded, the Customer will be billed \u20ac20 (net of VAT) per month for each additional 15 GB.<\/p>\n<h4>7.3 <strong>Data loss and service interruptions<\/strong><\/h4>\n<p>WELLSY cannot be held responsible for data loss, service interruptions or other technical problems beyond its control. In the event of data loss or corruption, WELLSY may reinstall one of the last two available backups.<\/p>\n<h4>7.4 <strong>Force majeure<\/strong><\/h4>\n<p>WELLSY cannot be held responsible in the event of force majeure affecting the provision of services.<\/p>\n<h3><strong>8. Intellectual property and data<\/strong><\/h3>\n<h4>8.1 <strong>Data ownership<\/strong><\/h4>\n<p>The Customer remains the owner of all content and data hosted on WELLSY servers.<\/p>\n<h4>8.2 <strong>Access and modification rights<\/strong><\/h4>\n<p>The Customer authorizes WELLSY to access, modify and intervene on the site and the data within the framework of the maintenance services.<\/p>\n<h4>8.3 <strong>Site transfer<\/strong><\/h4>\n<p>In the event of termination, WELLSY undertakes to provide the Customer with the information necessary to transfer the site to another server.<\/p>\n<h3><strong>9. Security<\/strong><\/h3>\n<h4>9.1 <strong>Safety measures<\/strong><\/h4>\n<p>WELLSY implements various security measures to protect Customer sites and data, including:<\/p>\n<ul>\n<li>Secure server configuration (different SSH port, no root access, limited user rights, etc.).<\/li>\n<li>CloudFlare CDN installation and configuration.<\/li>\n<li>Installation of security plugins on customer sites (WordFence, Headers Security Advanced &amp; HSTS WP).<\/li>\n<\/ul>\n<h3><strong>10. DNS and SMTP management<\/strong><\/h3>\n<h4>10.1 <strong>DNS management<\/strong><\/h4>\n<p>WELLSY offers complete DNS management via CloudFlare.<\/p>\n<h4>10.2 <strong>SMTP service<\/strong><\/h4>\n<p>WELLSY configures the SMTP service for e-mail deliverability via Brevo. The Customer must create a Brevo account and provide WELLSY with credentials for configuration. The Customer is responsible for the management and costs associated with his Brevo account.<\/p>\n<h3><strong>11. Support and assistance<\/strong><\/h3>\n<h4>11.1 <strong>Contact<\/strong><\/h4>\n<p>Support is available exclusively by e-mail at the following address <a rel=\"noopener\">support@wellsy.io<\/a>. All requests must be detailed and sent by this means.<\/p>\n<h4>11.2 <strong>Opening hours<\/strong><\/h4>\n<p>Support is available Monday to Friday, from 9:00 to 12:00 and from 14:00 to 17:00 (UTC+1).<\/p>\n<h4>11.3 <strong>Response times<\/strong><\/h4>\n<p>WELLSY endeavours to respond to requests within an average of one working day, with a maximum of 7 calendar days.<\/p>\n<h3><strong>12. Subcontracting<\/strong><\/h3>\n<p>WELLSY may use subcontractors to provide certain services, in particular Hostinger and CloudFlare. In such cases, subcontractors assume their own responsibilities.<\/p>\n<h3><strong>13. Personal data<\/strong><\/h3>\n<h4>13.1 <strong>Privacy<\/strong><\/h4>\n<p>WELLSY undertakes to respect the confidentiality of the Customer's personal data and not to disclose them to third parties, except in the context of the subcontracting mentioned in article 12.<\/p>\n<h3><strong>14. Changes to the GTC<\/strong><\/h3>\n<p>WELLSY reserves the right to modify these GTC at any time. Modifications will be published on the <a href=\"https:\/\/wellsy.io\/en\/\" target=\"_new\" rel=\"noopener\">https:\/\/wellsy.io<\/a> and will apply immediately. The customer accepts these modifications as long as his commitment is in progress.<\/p>\n<h3><strong>15. Applicable law and jurisdiction<\/strong><\/h3>\n<p>These GTC are governed by UAE law. In the event of a dispute, the parties agree to seek an amicable solution. Failing this, the Paris Commercial Court will be empowered to settle the dispute.<\/p>\n<h3><strong>16.
